Acceptance of these terms

These Terms of Use ("Terms") govern your use of the FitX7 Member, Trainer and Partner apps and the website fitx7.com (the "Platform"), operated by FitX7 Fitness Private Limited, 419, Vardhman Sampada, Sirsi Road, Jaipur, Rajasthan, India ("FitX7", "we", "us"). By creating an account or using the Platform you agree to these Terms, our Privacy Policy and our Refund & Cancellation Policy. If you do not agree, please do not use the Platform.

This document is an electronic record under the Information Technology Act, 2000 and does not need a physical or digital signature.

About FitX7

FitX7 is a marketplace that connects members with independent fitness facilities — gyms, pools, yoga studios, health and wellness centres ("Partners") — and with independent personal trainers ("Trainers"). FitX7 does not own or operate the Partner facilities and does not employ the Trainers. Each Partner and Trainer is responsible for the services, equipment, premises and staff it provides.

Eligibility & your account

• You must be at least 18 years old, or 13–17 with the consent and supervision of a parent or guardian who accepts these Terms on your behalf.
• You sign up with your mobile number and must give accurate, current information.
• Your account is personal. Do not share it, your OTPs or your check-in QR with anyone. You are responsible for all activity on your account.
• Tell us immediately at admin@fitx7.com if you think your account has been misused.

Credits, pricing & payments

• Pay & Go or credits: you can pay per visit, or buy prepaid FitX7 credits in the FitX7 Member app and spend them at any Partner or on Trainer sessions in any launched city.
• Price before you scan: the price of each visit or session is shown in the app before you confirm. Once confirmed, that amount is deducted from your wallet.
• Payments: processed through authorised payment gateways (UPI, cards, net banking, wallets) or app-store billing. Prices include applicable taxes unless stated otherwise.
• Credits are not money: credits are a prepaid instrument for use only on the Platform. They cannot be transferred to another user, exchanged for cash or withdrawn, except as set out in our Refund & Cancellation Policy.
• Promotional credits (bonus, referral or free credits) may have their own expiry and conditions shown at the time they are given, and are never refundable.
• We may change prices, credit packs and offers in future; changes never affect credits you have already bought.

Visits & partner rules

• Check in by scanning the Partner's QR code in the app while at the venue. A visit is valid only at the scanned Partner, for that visit.
• Follow each Partner's rules — timings, dress code, lockers, hygiene, booking slots and capacity limits. Partners may refuse entry or ask you to leave for breaking their rules or for unsafe behaviour.
• Partners may require a valid photo ID that matches your profile.
• Partner timings, facilities and availability may change. We try to keep listings accurate but cannot guarantee them.

Trainer sessions

• Trainer sessions can be booked singly or as packs, offline at a Partner or online, at the price shown in the app.
• Cancellation and no-show rules for sessions are set out in our Refund & Cancellation Policy.
• Trainers are independent professionals. FitX7 verifies basic details at onboarding but does not supervise each session.

Health & safety

Exercise carries risk of injury. Consult a doctor before starting any fitness programme, especially if you have a medical condition, are pregnant or are recovering from injury. You take part in all activities at your own risk. Fitness or nutrition content on the Platform (including our blog and calculators) is general information, not medical advice.

Acceptable use

You must not:

• share, sell or transfer your account, credits or check-in QR, or check in on behalf of someone else;
• fake a location, tamper with QR codes, or otherwise try to obtain visits without paying;
• harass, abuse or endanger Partners, Trainers, staff or other members, or damage any facility;
• post false reviews or unlawful, offensive or misleading content;
• reverse-engineer, scrape, overload or interfere with the Platform, or use it for any unlawful purpose.

Partners & trainers

Partners and Trainers using the FitX7 Partner or Trainer apps also agree to the commercial terms in their onboarding agreement with FitX7 (including revenue share, settlement cycles and service standards). If that agreement conflicts with these Terms, the agreement prevails for that relationship. Partners and Trainers must hold all licences, registrations, certifications and insurance their services require, and must handle member data only to deliver FitX7 services.

Intellectual property

The FitX7 name, logo, apps, website, design and content belong to FitX7 Fitness Private Limited or its licensors. You receive a limited, personal, non-transferable licence to use the apps for their intended purpose. You may not copy, modify or reuse them without our written permission.

Disclaimers & limitation of liability

• The Platform is provided "as is" and "as available". We do not guarantee it will always be uninterrupted or error-free.
• FitX7 is not responsible for the premises, equipment, services, staff or conduct of Partners or Trainers, or for injury, loss or theft at a Partner facility, except where caused by our own negligence.
• To the extent permitted by law, our total liability to you for any claim is limited to the amount you paid FitX7 in the three months before the claim arose. Nothing in these Terms limits liability that cannot be limited under Indian law.
• You agree to indemnify FitX7 against claims arising from your breach of these Terms or misuse of the Platform.

Suspension & termination

You may stop using the Platform and delete your account at any time. We may suspend or close accounts involved in fraud, misuse, abuse or breach of these Terms; credits obtained through fraud will be cancelled. Where we close an account without fault on your part, we will refund unused paid credits as described in our Refund & Cancellation Policy.

Governing law & disputes

These Terms are governed by the laws of India. Please contact us first — most issues can be resolved quickly. Any dispute not resolved within 30 days will be subject to the exclusive jurisdiction of the courts at Jaipur, Rajasthan, without affecting any rights you have under the Consumer Protection Act, 2019.

We may update these Terms from time to time. The date at the top shows the latest version; continuing to use the Platform after a change means you accept it.
